James Badenoch

 A renegade from a far-flung medical family dynasty, (father, grandfather, five uncles, two great uncles and seven cousins all doctors or surgeons).

Born, raised and latterly educated in Oxford, where his late father, Sir John, was sometime Director of Clinical Studies (Dean of the Medical School), a physician of many honours and distinctions, and a pioneer of gastroscopy.

Called to the bar by Lincoln’s Inn in 1968, he was pupil to John (later Mr Justice) Alliott, and Harry (Lord) Woolf, who became Master of the Rolls and Lord Chief Justice. His practice at 1 Crown Office Row in the Temple was originally as a general common lawyer of the kind all in his chambers used to be, but for the last 25 plus years he has specialised in medical negligence, medical law and medical discipline.

He was appointed Queen’s Counsel in 1989. He has appeared in the House of Lords in Wilsher v. the Essex Area Health Authority, (the seminal medical negligence case of the late 20th century, and in a succession of major medically oriented cases in the High Court, the Court of Appeal and the Privy Council.

He is a Deputy High Court Judge, a Recorder of the Crown Court, a President of the Mental Health Review tribunal, a Member of the Chartered Institute of Arbitrators, and an accredited Mediator and a Fellow of the Royal Society of Medicine. He has been admitted to the Hong Kong bar.

He has since 2004 been Chairman of the Expert Witness Institute, which with his work at the bar has kept him constantly involved with expert witnesses, and has given him a particular interest in all matters affecting them and expert evidence generally.

He lectures regularly, and is a frequent after-dinner speaker and an occasional broadcaster on TV and Radio. He has addressed by invitation among others: the Parliamentary and Scientific Committee of the House of Commons and Lords, the Senior Judiciary, Royal Colleges, assorted Learned Societies, numerous medical, surgical and expert witness conferences, seminars and gatherings, AvMA, APIL, the Hong Kong bar, the Royal Society of Medicine, and the BMA.

His publications include contributions to Clinical Negligence, Powers and Harris, published by Butterworths, 1st, 2nd, 3rd and 4th Editions. Urology and the Law, (Co-Author) published by Informa 2006. Numerous articles in Learned Journals and Periodicals.

Dr Harry Brunjes

Dr Harry Brünjes graduated from London University and Guy’s Hospital. He is Chairman of The Premier Medical Group and Non-Executive Director of Professional Medical Finance. Other appointments included Chairman, PI Forum, BUPA and RTA Ltd. Harry is a Governor of the Expert Witness Institute. He is a former Chairman of AMRO. Other roles include Chairman of Lancing College and a Fellow of the Royal Society of Medicine. In 2007 Harry was President of the Sussex Medical Society.
Harry enjoys sport, music and theatre. He has played piano professionally and is a regular writer, broadcaster and lecturer.

Martin Gargin

Mr Martin Gargan MA (Oxon) BM, BCh, FRCS (Tr & Orth)
Consultant Orthopaedic Surgeon.

Martin Gargan was educated at St Peter’s School York as a York City Scholar. He went up to Oxford to study medicine in 1978 after a spell at the Webb School of California as an English Speaking Union Scholar. He graduated from Oxford in 1984 and completed junior doctors posts in Oxford, Liverpool and Bristol before being awarded his FRCS in 1988. His postgraduate orthopaedic training was on the Oxford rotation but included a special fellowship at the Hospital for Sick Children at Great Ormond Street before being appointed as a Consultant in Bristol in 1994.

His main clinical interests are in trauma, paediatric orthopaedics along with surgery for dysplasia of the adolescent hip. He is interested in education and has been programme director for the South-West deanery for five years. He is an examiner for the Intercollegiate Specialty examination in trauma and orthopaedics and also a visiting examiner for a number of other institutions. He was voted teacher of the year by the undergraduates in 2002. He remains active in research and has published many articles on whiplash injuries in peer review journals. In 1993 he was the General Motors/Royal College of Surgeons Trauma Fellow in Detroit, Michigan.

Martin enjoys all sports. He gained three Blues in rugby union at Oxford as well as representing the Barbarians FC. He continues to enjoy golf and plays off a handicap of 9. His other main interests are his family and he has three young daughters – The Gargettes!

Cabella Lowe

Lecture title: “Evidence-Based Physiotherapy for Whiplash Associated Disorders”

Speaker: Cabella Lowe GradDipPhys MSc MMACP, Professional Head of Physiotherapy, Nuffield Health Wellbeing

Biography: Cabella trained as a physiotherapist at the West Middlesex University Hospital and after initially working in the NHS, has spent the rest of her career working in the private sector.  She has worked in a variety of clinical settings including elite sports and running her own multidisciplinary clinic.  In 1999 she completed a Masters degree in Manipulative Physiotherapy and was awarded the Churchill Livingstone prize for best student.

In 2003 she joined the company that was later to become Nuffield Health and, in 2007, was appointed Professional Head of Physiotherapy. This role includes responsibility for the governance of Nuffield Health’s employed and third party physiotherapy network which is the largest provider of physiotherapy outside the public sector, a service for which Nuffield was finalist in the 2010 Lang & Buisson Independent Healthcare Awards.

In 2008 she coordinated the development of ten evidence-based pathways for commonly seen musculoskeletal conditions, including one for whiplash associated disorders which is presented at conference.  These pathways provide a “gold standard” of evidence-based practice which facilitates robust governance and cost management of physiotherapy referrals.

Cabella sits on the Chartered Society of Physiotherapy’s sub-committee for Professional Practice & Service Delivery, the Physiotherapy Research Priorities Project Expert Panel, and the Executive Committee of the Manipulation Association of Chartered Physiotherapists.

Roddy Macleod

Roddy Macleod is a Partner in Weightmans LLP and is based in Manchester.

Throughout his legal career he has specialised in Defendant personal injury work.

His portfolio of work stretches from catastrophic injury claims to occupational stress claims. He has a particular interest in occupier’s liability claims, having successfully defended the leading cases of Tomlinson (House of Lords) and Poppleton (Court of Appeal).

His interest in privilege issues arises out of the substantial number of medical reports he has had to read throughout his career.

Away from work he leads a sedentary lifestyle and at his recent annual medical he was advised that some exercise might be a good thing!

Tim Oliver

Tim Oliver qualified as a solicitor in 1986, joining the Parabis Group in 2000 where he is now Group Chief Executive and Senior Partner of Plexus Law. Parabis provides legal services to the Insurance Industry as well as incorporating rapidly growing claims handling, loss adjusting health and safety and rehabilitation divisions..

During the past 10 years Parabis has acquired 12 businesses all of which have been successfully integrated
into the Group.

A lot of his legal career has been spent advising the Travel Industry but he also edited the 10th and 11th edition of Binghams and Berrymans Motor Claims and Co-Authored Oliver & Dingemans on Employers Liability.

He has many interests outside of the Law and amongst other things is a Borough Councillor, Chairman of the Trustees of The Shooting Star Children’s Hospice, School Governor.

He became President of FOIL in November 2010.

Donna Scully

Donna Scully was born in Dublin.

Donna qualified as a Solicitor in the UK in 1995 and worked originally in London at Mishcon de Reya and Jeffrey Green Russell Solicitors amongst others before setting up a Personal Injury department at Carpenters Solicitors in 1997.

 Carpenters has since grown into a National niche Claimant Personal Injury practice employing nearly 300 people.

 Donna has been a member of the Management Committee of the Motor Accident Solicitors’ Society (MASS) since 2004.  She took up the role of Chairman in November 2010. 

 Donna is also a long standing member of the Association of Personal Injury Lawyers (APIL).

 Donna is an Ambassador on the I Love Claims Advisory Board since its inception in 2010.

 She is a keen supporter of the victims of accidents and has long campaigned for their rights.

 Donna is the mother of 10 year old twin boys and she tries to keep fit in the little free time she has!  She supports Liverpool FC and is a keen wine drinker!

Amanda Stevens

Amanda Stevens

Amanda’s working career commenced in the National Health Service where she qualified as a member of the Institute of Health Services Management.  She qualified as a solicitor in September 1990.  Formerly a partner at Charles Russell and overall Head of the Personal Injury and Clinical Negligence group, she joined Irwin Mitchell’s Holborn office in July 2010 as a partner in charge of a team specialising in medical law and serious injury.

Amanda was APIL President in 2008/2009.  For a number of years she has been APIL’s “Rehab Champion” and was the claimant representative on the drafting committee for the 2007 Rehabilitation Code.  She is a member of the IUA/ABI working group on rehabilitation, a founding director and trustee of the UK Rehabilitation Council and a member of the Bodily Injury Claims Management Association.

Amanda is also a member of the Clinical Disputes Forum and the Advisory Council of Trust Mediation, a not for profit dispute resolution service chaired by Sir Henry Brookes.  Amanda is a member of the Multi-Track Code Pilot Review Body and the Civil Procedure Rule Committee.

Amanda is a regular contributor at national conferences and in the press.  She has assisted in drafting numerous briefing papers to MPs and the Lords as well as attending them in person on various matters including Coroner’s reform and employers liability and insurance matters.

Amanda is on the Spinal Injuries Association Solicitor’s List, a member of Headway – the Brain Injury Association Personal Injuries Solicitor’s List and an APIL Fellow.  She is described in a leading High Court judgement as “being particularly impressive and experienced”.

Alan Strange is the Underwriting Director of LAMP Group Limited, a specialist Legal Expenses & Medical insurance group. LAMP pride themselves on being flexible and are able to customise solutions for their clients.

Prior to this he was at Europ Assistance and was Business Director – Legal, heading up the Legal Expenses Insurance division. Alan left EA in March 2005 to set up LAMP.

Alan has been in the insurance industry for 15 years, underwriting variously Motor, Household, Travel, Assistance and Legal Expenses Insurance. He is an Associate of the Chartered Insurance Institute and a Chartered Insurer.
