Mesothelioma widow compensated seven years later

A widow received a £218,000 payout for her husbands death after a seven year wait.

The women’s husband died of mesothelioma in 2001 after exposure at the Turner and Newell factory at which he worked. Claims against the company were frozen in 2001 because their US parent company Federal Mogul went into administration in the UK.

Payments to victims started emerging last year when a trust was set up by the administrators, approved by the High Court. An employers' liability insurance fund will pay compensation to those who worked for T&N after 1969. This fund is financed from insurers, Royal Sun Alliance and Lloyds, who wrote employers' liability insurance from T&N after 1969.

The widow carried on her husband’s fight for compensation after his death because he was angry with his employers about them exposing him  to asbestos.

She said: “He was shocked when he was diagnosed but he had always had a suspicion that working with asbestos would catch up with him. He was very angry and he wanted T&N to pay for the loss of his life.”

“It has been a long wait but we’ve finally got justice. I have been lucky to get the money but it does not compensate anyone. If I could swap it, I would.”

Client representative at Thompsons Solicitors Diana Fos said:

“It is important that other victims of asbestos related disease caused by exposure from companies within the Turner & Newall group should be aware that they may be entitled to compensation. Claims can be made to the Trust on behalf of living and deceased victims of asbestos related disease.”
